Damaging Nyack Potholes Grow Larger And Deeper As Winter Continues

The continued rain we have experienced this winter has had a detrimental effect on Nyack’s roads.  Water freezing and expanding in our roadways each night enlarge potholes as nature continues to chip away at their edges. Salt and plows just compound the problem. Yonkers has started an interesting program where they encourage residents to take pictures of potholes and post to their Facebook page. Maybe a similar program could speed the repair process on our streets. These holes certainly wreak havoc on our automobiles.  Do you have rights for recovery if your car is damaged in a pothole mishap?  The answer is MAYBE!

First you have to determine if the pothole was on a State, County, or Town road. New York State law exempts them from paying for pothole caused damage between November 16th and April 30th. NYC has an on-line claim form, but the pothole must have been reported prior to your claim. County and town municipalities seem more responsive, but still require the pothole to have been previously reported. Documentation is always important. Take pictures and report the pothole immediately. Today most auto insurance policies have higher out-of-pocket deductible amounts, so there is little help there.Image title
